
Please read these terms and conditions carefully before registering for this American Physician Institute for Advanced Professional Studies LLC (“American Physician”) Course. By registering and/or participating in this course, you signify that you accept the provisions of these Terms & Conditions and that you are entering into a legally binding agreement with American Physician.
Your Course tuition and fees cover and include the following:
Online material and course content will be available for a minimum of one year following the administration of the associated exam. For example, 2012 course materials will be available through the 2013 exam. If your exam is further than one year out, please contact Customer Service to extend your access.
Your Course tuition and fees do NOT cover the following personal, non-Course expenses:
When you purchase a Live or Home Study Course, you are licensing it for individual use only. Course materials may not be resold or distributed in any way. Personal recording of audio or video from the Course is prohibited. Reproduction (electronic or otherwise) of any and all Course materials without the express written consent of American Physician is strictly prohibited. American Physician invests significantly in developing its course materials and diligently defends its trademarks and copyrights.
American Physician makes every reasonable effort to adhere to its schedule of Courses. However, all American Physician Courses are subject to rescheduling/change; American Physician reserves the right to change Course locations, dates, speakers, and session schedules at its discretion as it deems necessary.
All cancellations MUST be made by phone by calling American Physician at 877-225-8384.
If you purchase a Course and cancel your registration up to 10 business days before the Course start date, you will receive a full refund minus a $100 cancellation fee. American Physician makes refund payments for Course cancellations to the party that has tendered the Course payment (such as the applicable check payer, credit card holder and the like).
If you cancel your registration less than 10 business days before the Course start date or you fail to attend the Course, NO refund will be provided. However, at its discretion, American Physician may apply your Course tuition to a Home Study Course or other Live Course.
If you purchase a Course with a “Triple Trust Guarantee” and do not pass your board exam, API will refund 100% of your tuition, pay you an additional $500, and allow you to participate in one guarantee Course tuition-free. You are further eligible to keep repeating the guarantee Course tuition-free once each subsequent time you take and fail the exam.
If the Course you purchased was a Live Course, then you have the option of registering for either a Live or Home Study guarantee Course. If the Course you purchased was a Home Study Course, your guarantee Course will be a Home Study Course.
Triple Trust Guarantee payments (100% tuition refund plus an additional $500) are made via check to the party who participated in the Course and is named on the board exam failure notice. No change in payments may be made unless American Physician is directed otherwise by written notice. American Physician disclaims liability to any party for payments and credits made in accordance with this policy.
To activate your guarantee you must notify American Physician in writing of your failure to pass within 45 days of the date of your exam notice, accompanied by the original exam notification.
Send your letter and the ORIGINAL copy of your exam notification to: American Physician Institute, 125 Windsor Dr. Suite 111, Oak Brook, IL 60523. Your original exam notification will be returned to you by U.S. mail with your Course guarantee refund check. You will also receive instructions on registering for a future, tuition-free guarantee Course.
Each time you activate your guarantee you must notify American Physician in writing. Failure to adhere to these guarantee terms and conditions will result in your guarantee being null and void.
Registration for a Guarantee Course is made by calling American Physician customer service at 877-225-8384.
For Live Guarantee Courses, registrations must occur at least 6 weeks before the Course start date. Note that many of our Live Courses sell out many weeks before their start date and your registration at the Guarantee Course is subject to availability. American Physician strongly recommends registering for your Guarantee Course as early as possible.
You may cancel or reschedule your guarantee Course registration up to 10 business days before the Course start date. If you cancel your registration less than 10 business days before the Course start date or you fail to attend the Course, you forfeit your guarantee Course and nullify the terms of your guarantee.
The “Triple Trust Guarantee” does NOT apply to the following products:
To qualify for a combined discounted tuition, you must purchase your courses at the same time. If you register for multiple Courses with a “Triple Trust Guarantee” at a combined discounted rate, you will receive a prorated guarantee payment based on the number of exams you fail. For example, if you purchase two Courses together at a combined discounted rate and fail one exam, American Physician will refund 50% of your combined tuition payment plus $250. In addition, you may participate in one Guarantee Course (designed for the exam you failed) with your tuition waived each time you take and fail your board exam. If you fail both exams, American Physician will refund 100% of your total combined tuition payment plus $500. In addition, you may participate in one Guarantee Course with your tuition waived for each exam you fail each time you take and fail that board exam.
If you purchase a Course through American Physician’s Group Purchase Program, your Course is eligible for the “Group Purchase Guarantee” which states that if you take and fail the exam for which the course is designed, you are eligible to register for one Course tuition-free once each time you take and fail your board exam. Courses purchased as part of the Group Purchase Program do not include and are not eligible for The Triple Trust Guarantee.
Although our Courses are useful in studying for a variety of board exams, the Triple Trust Guarantee applies only when you fail the board exam for which the course you purchased was specifically designed. For example, if you purchase the Geriatric Medicine course but fail the Psychiatry MOC exam, the Guarantee does not apply. Any exams with an oral presentation component are specifically excluded from the Triple Trust Guarantee. Further, The Triple Trust Guarantee only applies to exams administered by ABMS-recognized board organizations, and therefore does not apply to AOA and non-US board exams.
The applicable limited guarantees and warranties set forth above (including without limitation the specific terms, conditions and restrictions stated in the applicable guarantee/warranty above) are the only guarantees and warranties made by American Physician to you in connection with the American Physician Course in which you are registering and/or participating under this Terms & Conditions Agreement and are made in lieu and instead of any other guarantees or warranties whatsoever, express or implied, in any other American Physician materials or otherwise expressed or implied by law.
Except as expressly guaranteed under the applicable guarantee/warranty contained in this Terms & Conditions Agreement, American Physician disclaims all other express or implied guarantees or warranties whatsoever as to any of its services, materials or products howsoever provided or sold by American Physician, including without limitation, warranties of merchant ability or fitness for any particular purpose.
American Physician hereby disclaims and you acknowledge and agree that American Physician shall not in any event be liable whatsoever for any and all indirect, compensatory, consequential, special, incidental, punitive or exemplary damages arising for any reason or on any basis.
You acknowledge and agree that your only claims as to any guarantee and/or warranty made by or attributable to American Physician are and shall be limited solely to the applicable guarantee and warranty contained in this Terms & Conditions Agreement, on the express terms and conditions set forth in this Terms & Conditions Agreement.
These Terms & Conditions supersede all prior agreements and understandings (whether written or oral) between American Physician and the registrant.
This agreement and these Terms & Conditions are governed by and construed under the internal laws of the State of Illinois. Jurisdiction and venue over the parties as to matters arising hereunder is vested in the state and federal courts sitting and/or with jurisdiction in DuPage County, Illinois.
